From what I can gather about Incapacity Benefit, prior to the assessment the claimant would have been sent a IB50 form.

I actually challenged the legality of atos having access to my information and sending me an IB50 form out in the first place without any notification from the data controller the DWP to myself, or without any specific request made by DWP to atos for them to do this.
